Barbados man denied bail dismissal in sexual assault case

A magistrate has ruled that serious allegations involving a complainant cannot be summarily dismissed, keeping the accused in custody.

Stephon Davidson Freeman, who has no fixed address, sought to have his rape and burglary charges dismissed during a court appearance, according to reporting by Barbados Today. Freeman is accused of sexually assaulting a woman without her consent on May 24, 2024, and breaking into her home on the same date, allegedly stealing a mobile phone valued at $850, a $120 bag, and other items.

Freeman has spent the past 28 months in custody on these charges. He also informed the court that he is currently serving a separate prison sentence for ammunition-related offenses and is scheduled for release in 2030. The police constable handling the case requested an adjournment, noting that investigative documents had not yet been submitted to the court.

The presiding magistrate rejected the dismissal request, emphasizing that cases involving victims cannot be treated the same as victimless offenses. According to Barbados Today’s account, the magistrate stated that complainants must have confidence that the justice system is working in their interest, and that dismissing such matters could undermine public faith in the courts. Freeman is scheduled to return to court on October 8.

The case reflects ongoing challenges within Barbados’s criminal justice system regarding case management and the balance between expediting proceedings and ensuring that complainants receive appropriate consideration from the courts.
